What Swolski is and is not

Swolski is boxing and fitness coaching software. As each part opens, it will plan training sessions, keep a training log, carry lessons, give a seat to the coach you train with, and review training clips. The home page says which of those parts is open today and which is in build.

Swolski is not medical advice, and it is not a doctor, a physical therapist or a dietitian. It does not diagnose, treat or prescribe anything. It is not an emergency service: if you are hurt or unwell, stop and get help from a person.

Your account

You must be 18 or older and live in the United States to use Swolski. An account is for one person. Keep your password to yourself and keep control of the email address you signed up with. You are responsible for what is done with your account.

Training and your health

Boxing and fitness training carry a risk of injury, and contact training carries a risk of serious injury, including to the brain. You train at your own risk. Before you start or change a training program, talk to a doctor if you have a health condition, have been inactive, or are unsure. Follow the instructions of your coach and your doctor over anything Swolski says. When a training feature of Swolski opens, these terms will be updated with the release of liability that applies to it, and you will be asked to accept it before you use that feature.

Using Swolski fairly

Use Swolski for your own training. Do not use it to break the law, to harm another person, to reach parts of it you were not given, to overload it, or to get around the limits of your plan. Do not put anyone else's health information into it without that person's agreement.

Plans, renewal and cancellation

No paid plan is on sale today. Accounts are free. The pricing page shows the plans that will open and their prices. When a paid plan opens, this section will apply to it. The plan renews automatically at the end of each month, at the price shown when you bought it or at a new price you were told of 7 to 30 days before it took effect, until you cancel. You can cancel at any time on the account page, or, if you cannot sign in, by writing to team@manic.agency from the email address of your account. Cancelling stops the next renewal, and your plan stays on until the end of the period you paid for. Swolski emails you at least 7 and at most 30 days before a price change takes effect, with how to cancel, and once a year with what your plan costs and how to cancel. The refunds and cancellation page says when a charge is refunded. Prices are in US dollars.

Your data

Everything you put into Swolski is yours, including your training log and clips when those parts open. You allow Manic Agency LLC and the companies named in the privacy policy to handle them only to provide the service to you, as the privacy policy and the consumer health data privacy policy describe. You can take everything out as a file and delete it at any time from your account.

Changes to the service

Swolski works to keep the service available but does not promise that it will always be available or free of errors. It may change features; it will not take away what a paid plan includes during a period you have paid for.

Liability

Swolski is provided as it is. To the extent the law allows, Manic Agency LLC is not liable for indirect or consequential losses, and its total liability to you is limited to what you paid for Swolski in the twelve months before the claim, or 100 US dollars if you paid nothing. Nothing in these terms limits liability that the law does not allow to be limited, or takes away rights that the law of the place where you live gives you.

Ending the agreement

You can stop using Swolski and delete your account at any time. Swolski may suspend or close an account that breaks these terms. If Swolski closes an account for any other reason, it refunds the part of a paid period not yet used.

Law

These terms are governed by the laws of the State of Nevada, without regard to its rules on conflicts of law. Nothing in them takes away rights you have under the laws of the place where you live.

Changes to these terms

Swolski emails account holders about a material change at least 30 days before it takes effect.
